The Day | Driving Up Rent

Good morning, East Village.

For some who attended last night’s meeting at Cooper Union, it may not be such a good morning. Protestors booed and jeered as the New York City Rent Guidelines Board took a preliminary vote to increase rent stabilized apartments between three to 5.75 percent for one year apartment leases, and up to nine percent for two year leases, with an additional one percent for oil-heated buildings, DNAinfo reports.

The board approved the increase with a 5-4 vote, citing the need to keep up with the growing operating costs for building owners. What’s next? Two more public hearings on June 16 and 20, before a final vote on June 27. Will you be in attendance? Let us know.

But hey, at least British royalty can still afford the neighborhood. On Saturday, the East Village tipped its hat to the famous newlyweds, with a fresh mural of Prince William and Kate Middleton holding court on the corner of East Houston and Avenue B. According to BoweryBoogie, Lower East Side artist Chico offered up his congratulatory message (only up for about three weeks) after being commissioned by Branson B. Champagne, a Harlem based liquor company.

And the rain, rain won’t go away–at least not for another day. Expect wet weather with a high of 55.


5 Questions With | Natasha Dillon

Natasha Dillon thinks she’s boring — but that’s not really the case at all.

Earlier this month, Borough President Scott Stringer announced the newly appointed selections to Community Board 3, which covers the East Village, Lower East Side and parts of Chinatown. Ms. Dillon, a 26-year-old East Villager and gay rights activist, was one of these new appointees, after previously serving on the board as a community member. And while some insist that this crop of new appointees seems rather eclectic, Ms. Dillon insists that she’s actually quite boring.

As a financial consultant, who’s currently working on a master’s degree in investment management from Pace University, Ms. Dillon seems like the average young East Village resident, except this activist and founder of a local East Village advocacy group, Queer Rising, has been arrested four times in the last year for her public actions for marriage equality in the United States. Her most recent arrest came earlier this month, after a group of Queer Rising members blocked traffic near Governor Andrew Cuomo’s Manhattan office on Third Avenue for nearly 10 minutes.

However, Ms. Dillon has a somewhat different, slightly less radical, agenda for the East Village. Serving on the economic development committee, her main concern is to bring life back to local businesses — and to the East Village.

Map Your Gripes

I recently attended a Community Board meeting where a representative from the Department of Information Technology and Telecommunications (DOITT) shared one of the newest updates to the 311 Online Services. An online service map, updated daily, shows residents the total amount of complaints made to 311 in any given area. In addition to being able to click on the complaint marked on the map by a yellow circle (relative in size to the amount of complaints per area), you can receive the status of the request.

Using this map, you can search by address, intersection, community board, city council district, or zip code. You may also narrow down the categories by using a pull-down menu to search for topics such as ‘sanitation’ or ‘public safety’. The map keeps information for up to 3 months, or using the advanced settings, data is stored for up to one year.

What’s the difference between a “call” and a “complaint?” Nick Sbordone of the DOITT explained that with a call, there is usually no follow-up required by the city. A complaint usually involves a service request, where the caller’s information and complaint is recorded and an action by one of the City’s Departments will follow.

It may be useful, or at least interesting, to track your own requests, those of your neighbors, or just to remain informed about any particular area’s happenings. Amid Glut, Liquor Licenses Still Sought

South Brooklyn Pizza outsideIan Duncan A passerby inspects South Brooklyn Pizza’s liquor license notice. Despite the hurdles of entering a thoroughly saturated market, owners of bars and restaurants are still flocking to the East Village – and filing applications for liquor licenses.

This weekend, the Post reported what we all kind of knew anyway. The East Village has more places to buy booze than any other neighborhood in the city: 474 in the 10003 zip code by their count. Cue mass eye-rolling in the blogosphere at the non-news.

Concerned by the profusion of bars, Community Board 3 and the authority have started to toughen up. Last month, the board narrowly voted down a liquor license application for a Mexican restaurant run by Two Boots Pizza owner Phil Hartman and music promoter Todd Patrick.

The reason for the proliferation of bars hinges on zoning technicalities and what critics say was the State Liquor Authority’s past trigger-happy attitude to handing out licenses.

That created momentum and now entrepreneurs are desperate to get a foothold in the neighborhood, despite the obstacles. Next Monday, 33 businesses will put their case for new or expanded licenses to the community board.

In a bold step, the owners of South Brooklyn Pizza labeled the community board “infamous” and urged their customers to sign a petition supporting their application. EV Grieve noted the claim, trigging much rumbling from the blog’s commenters.

Liquor License Opposed for Venue

The State Liquor Authority Committee of Community Board 3 Monday night refused to endorse a liquor license for a proposed music and restaurant space on Avenue A. With the 4-3 vote, the committee turned aside a proposal to open a new Mexican restaurant and lounge at 34 Avenue A. The proposal had been submitted by several owners, including Phil Hartman, who owns Two Boots Pizza and a former venue, Mo Pitkin’s House of Satisfaction, and the music promoter Todd Patrick; the fate of the project is unclear. —Hadas Goshen


Bar Owners to Fight New Rules

Community Board 3 should be taking a rest from conflict. Last week, in a vote meant to end five months of debate, it finally passed a set of reforms to the way it makes recommendations about licenses to the State Liquor Authority. But bar owners who sit on the board are not satisfied and have vowed to challenge the new rules and investigate why they were banned from voting on the reform package.

Shortly before last Tuesday’s meeting, a complaint was made against David McWater, a board member who owns three bars on the Lower East Side. Susan Stetzer, Community Board 3’s district manager, referred it to the city’s Conflicts of Interest Board. In a written response, COIB officials recommended that the three bar owners on the board be barred from voting on the reform resolution, as they had a direct financial stake in the vote.

At the meeting, Ariel Palitz, a board member who owns Sutra Lounge on First Avenue at First Street, called the recommendation an “eleventh-hour attempt to gag” bar owners. Mr. McWater, who was recovering from a fall, was absent from last week’s meeting.

Conversation | Liquor Licenses

Earlier this week, Community Board 3 voted to amend the policies for transferring liquor licenses when local businesses are bought and sold.

Save the Lower East Side said that the move “may be the most significant vote” that the board has ever taken.

The blog theorized that the move might reverse a trend that has seen rents rise and created a dense cluster of bars in the neighborhood.

“If prospective bar owners know that they must face the community to get license approval, they will be less likely to buy that business, especially here in areas of bar density, where there will be the most community objection. If bars are reluctant, landlords can’t count on high-rent bars for their commercial spaces, and will have to settle for lower-rent businesses. That will lower commercial rents and bring commercial diversity.”

Board Overhauls Liquor License Process

Debate 3Ian Duncan Members of Community Board 3 debated changes to the liquor licensing process Tuesday night during a meeting at P.S. 20.

Ending months of debate, Community Board 3 Tuesday night approved a sweeping overhaul of the way it makes recommendations to the State Liquor Authority for alcohol license applications.

As the motion passed, by a vote of 37 to 1, attendees made hasty moves for the exit. When board members were asked toward the end of the three hour meeting at P.S. 20 whether they wanted further time to debate, there were groans and calls of “No!”

The vote ended five months of consultation and debate, some of it acrimonious, about the new policies, which are aimed at providing applicants with clarity and guidelines to follow if they are awarded a license.

Much of the debate focused around so-called “transfers” or the ability to pass liquor licenses on to new owners following the sale of business. Bar and restaurant owners had argued this increases the value of the business and any moves to change the policy would hurt them financially.

Under the policy adopted Tuesday night, the board’s State Liquor Authority committee will review transfers of licenses as though they are new applications. In the past they had been automatically approved. The committee does not have the final say over licensing decisions but passes on recommendations to the State Liquor Authority.

Mourning A Loss Beyond Mars Bar

John Vaccaro, a theater director active in the downtown arts scene of the 1960’s and 1970’s, has lived in his sprawling, bespoke loft on Second Avenue for several decades. The vast space is filled with artwork from local friends – including various portraits of himself that Mr. Vaccaro has received as gifts – furniture and other odd items found around the East Village over the years.

If the project, which was endorsed by Community Board 3 last week, moves forward, Mr. Vaccaro’s building, 11-17 Second Avenue, will be one of two torn down to create a single 12-story building. The project will also force the temporary closure of the landmark Mars Bar, which is also on the site. Current residents will be offered units in the new development with an option to buy for just $1. But those living in 2,000 sq. ft. lofts like Mr. Vaccaro will have to adjust to downsized apartments closer to 1,200 sq. ft.

Even as many in the neighborhood have lamented the loss of Mars Bar, Mr. Vaccaro, who is 81, stands to lose far more: his home.

Committee Approves Housing Plan

9-17 Second AvenueStephanie Butnick The housing committee of Community Board 3 approved a plan to renovate a string of properties at 9 and 11-17 Second Avenue. The next step is a vote by the full community board Dec. 21.

The housing committee of Community Board 3 tonight endorsed a proposal to renovate a string of properties along a stretch of Second Avenue and turn them into a new mixed-income development.

The move also brings the temporary closure of the iconic Mars Bar, which is located on one of the properties, a bit closer to becoming a reality. The bar, a fabled East Village haunt, would likely remain closed for the two years it will take to renovate the property.

Representatives from the project’s developer, BFC Partners, and the Urban Homesteading Assistance Board explained the project, which would rebuild properties at 9 and 11-17 Second Avenue – currently in various states of disrepair and in some cases, code violation – into a single 12-story building offering both permanently affordable housing and market-rate units.

A tenant from 11-17, Gretchen Green, spoke in support of the project, saying “It’s going to give me an apartment where I can close the windows, and a safe place for my daughter and grandson to visit.”

The existing tenants of both buildings will be offered space in the new building – with the option to buy the new apartments for $1. A low fee to be sure, but – under the terms of the renovation agreement – the apartments will never be allowed to be offered at market rate (the re-sale price for the units is about $180,000).

Not all tenants are as optimistic as Ms. Green. John Vaccaro, a resident 11-17 Second Avenue for more than three decades who did not attend the meeting, told The Local afterward, “I don’t support them taking down what should be a landmarked building.” And, at 81, he is not keen to be relocated for the roughly two years it would take for the project to be completed.

Nevertheless, the committee voted to recommend the project, with one committee member abstaining – Val Orselli of the Cooper Square Mutual Housing Association declined to vote, citing a past professional relationship with the developers.

And what of the Mars Bar? It’ll be resurrected in the renovated space, owner Hank Penza says: “bigger and better, but with the same attitude.”

The next step is a Dec. 21 meeting, where the full Community Board will vote on the project.


Plan Would Add Low Income Housing

Developers are expected to seek Community Board approval Wednesday for a plan to renovate a row of properties along Second Avenue, and sell some of the apartments to low-income families for as little as $1.

The mostly low-income families who currently live in the two buildings at 9 and 11-17 Second Avenue are guaranteed units in the proposed development, which would combine the two structures into one larger building.

The project, run by development firm BFC Partners, is operating under the Department of City Planning’s 2009 amendment to the inclusionary housing program, which creates permanently affordable housing, now with the option to buy. According to Juan Barahona of the development firm, tenants will be able to buy the new apartments for between $1 and $10.

The project will also take advantage of new zoning laws that allow developers to build more square footage on a lot, provided they allocate 20 percent of the building’s total area to affordable housing.

In this case, the 12-story, 4,000 sq. ft. building will house approximately 12 low-income units (available to those making 80 percent or less of the area’s median income ̶ approximately $63,000), dispersed throughout the complex, and about 48 market rate units. The development’s market-rate units, which make up the majority of the building, will offset costs.

Two Refused By Liquor License Panel

A Community Board panel Monday night refused to lend its support to plans to reopen two bars on Avenue A, despite pre-emptive efforts by business owners to smooth things over with East Village residents fed up with noisy nightlife in their neighborhood.

The State Liquor Authority Committee, which helps regulates liquor licenses in the East Village for Community Board 3, declined to lend its support to an application for the new space at 34 Avenue A, formally Aces & Eights, saying the area already has enough bars.

The committee also deflected a request from the owner of the former Superdive space at 200 Avenue A, explaining that the board had initially approved a license at that location for a bookstore or cafe. The State Liquor Authority subsequently permitted a change to let tenants apply for a liquor license, but the committee wants to stick with the board’s original decision.

All Quiet in Tompkins Square Park

Tompkins Square Park was more or less empty Sunday night, save for a few extra auxiliary police vehicles and a rag-tag bunch of seemingly bewildered protesters, all in search of a protest that did not happen, despite lively online previews and last-minute reminders.

“Jerry The Peddler,” the “Slum Goddess,” and one or two other local characters showed up to protest Community Board 3’s new policy designed to implement a “better management of scheduling” and control some “volume issues,” according to Susan Stetzer, the board’s district manager. She told The Local by e-mail that the repercussions of the policy have been “exaggerated greatly,” but Jerry Levy, 56, who’s lived in the East Village for 33 years, said Sunday night that he thinks the issue isn’t the volume, but the changing guard of the community.

“If people who live there” – on Seventh Street between Avenues A and B “have issues with the volume, then they shouldn’t have moved there,” he said. “The community overwhelmingly supports the concerts. This” – the noise proposal – “just comes from a few people who are speaking to a receptive ear of a few reactionary members of the community board.”

He says that the community wants “nice, quiet smiley-faced type of events that are geared toward children,” and that the community board “doesn’t represent the community.”

The community did not, however, turn out in overwhelming numbers to support that point of view. Indeed, John Penley, the longtime East Village activist and photojournalist who organized the protest, was nowhere to be found when the time came to demonstrate. Mr. Penley had not returned earlier calls from The Local about the event.


Board Refuses to Endorse Smoking Ban

Smoking is allowed here – that was the message Community Board 3 sent to anti-smoking groups Thursday night by refusing to endorse legislation that would broaden the city’s ban on smoking in public.

Staff from the American Lung Association in New York and Asian Americans for Equality asked the board for a resolution supporting City Councilwoman Gale Brewer’s proposed expansion of the smoking ban. In their request, the anti-smoking groups cited the high rates of smoking in the district: 18.3 percent vs. 15.6 percent citywide.

Councilwoman Brewer’s proposal would extend the existing ban at restaurants and bars to such outdoor locations as parks and beaches.

The resolution from the board would have largely been a symbolic gesture: it would indicate to City Council that the district’s leadership supported the legislation.

But when asked if they wanted to make a motion, board members were conspicuously silent. A motion must be made before a vote on a resolution can take place: no motion, no resolution.

“The government is crossing the line – it’s over-legislation,” Community Board member Tom Parker said in an interview after the meeting, explaining his refusal to support the resolution. “Look, both my parents died of smoking. But it’s an outdoor activity. Where are people supposed to go?”

Still, Lisa Spitzner, of the American Lung Association in New York, remained optimistic, saying that one of the group’s main goals Thursday night was to get the word out to the community about smoking cessation programs. “This is the best way to do it,” she said.

Path to Liquor License Often Bumpy

Liquor licensing is the hot topic in the East Village, with some residents railing against the noise and violence that they say booze brings.

But cafe owners looking to put alcohol on their menus to make money said that applying for a license is a head-spinning process that often ends with them being painted as villains.

Take the Case of Table 12, the 24-hour diner on Avenue A and East 12th Street. On Sept. 20, the liquor authority committee for CB3, which represents the East Village, refused to recommend Table 12’s application to the State Liquor Authority to sell beer and wine. On Sept. 28, the full board upheld the committee’s decisions on a number of East Village liquor license applicants, including the denial of Table 12.

A brother of Table 12’s owner, who identified himself only as Tarik, said that the diner’s license application was submitted to help give patrons a “better dining experience” and also for the profit potential.

“It’s why the place is open for business,” he said. “A cafe is not open for non-profit.”

The Day | A Vote on Loud Concerts

On Tuesday night, Community Board 3 voted overwhelmingly to pass a measure that would restrict the number of concerts using amplified sound at Tompkins Square to one day per weekend.

Although the proposal passed without debate, Susan Stetzer, the district manager of Community Board 3, told NYU Journalism’s Timothy J. Stenovec that she was surprised by the level of vitriol about the measure in the blogosphere.

Ms. Stetzer took particular exception to the characterization by one commenter on EVGrieve who described her as “a self-appointed sound-nazi.”

“You don’t call people Nazis,” Ms. Stetzer told Mr. Stenovec after the meeting.

Ms. Stetzer also denied that there was any political motivation behind the measure.

“No one’s against concerts, no one’s against any type of concerts, no one’s against political activity,” Ms. Stetzer told Mr. Stenovec. “All that’s asked is that certain concerts that are very loud, and we’re not saying which ones, just take it down a notch.”

The Day | Speaking Out on Noise, Bars

The State Liquor Authority Committee and Department of Consumer Affairs Licensing Committee for Community Board 3 met for three hours Monday night and the discussion centered on two of the neighborhood’s hot-button issues: the granting of liquor licenses and noise complaints.

NYU Journalism’s Molly O’Toole reports that many of the roughly 30 people who attended the meeting asked committee members about whether more restrictions should be placed on provisions for transferring liquor licenses from one business to another.

Currently, the holders of liquor licenses may sell them like any other asset. And Ms. O’Toole reports that Susan Stetzer, the district manager of Community Board 3, said that landlords — and previous owners — are using the lure of those licenses to demand high selling prices and higher rent for incoming tenants who want to open businesses that sell alcohol. Under the current rules, new tenants in that situation can immediately acquire a temporary license and begin operating.

“Transfers is the single issue that has this committee and our community in its vice grips,” one resident said, noting the public opposition last week to the granting of a license to Table 12, a diner on Avenue A.

Ms. O’Toole also reports that some residents believe that the high volume of noise complaints in the neighborhood — 2,324 complaints have been called in to the 311 hotline for city services as of June, the most from any community board district in the city – may be partly attributed to the city’s smoking ban in restaurants. Smokers, who go outside to light up, are sometimes the source of noise complaints.

“The community is paying for what Bloomberg should have thought out,” said David Mulkins, a frequent critic of licensing rules who lives on East Fifth Street near Second Avenue. Mr. Mulkins directed his ire at Mayor Michael R. Bloomberg, who recently proposed broadening the smoking ban.

Peter Bradley, another resident of East Fifth, expressed frustration that not enough was being done to address the concerns of community members.

“We’re like a dog with no teeth,” said Mr. Bradley. “We bark a lot, but not much seems to change.”

We’d also like to remind you that residents will have another chance to be heard when Community Board 3 holds a full board meeting tonight at 6:30 at P.S. 20, 166 Essex Street (between East Houston and Stanton Streets). Besides issues related to alcohol, EV Grieve notes that the board may also consider a measure to limit the number of concerts in Tompkins Square Park.


Businesses: Bike Lanes Slow Deliveries

Cyclists in bike laneMariya Abedi Some East Village business owners say that recently installed bike lanes are adversely affecting their deliveries.

New bike lanes may be a welcome sight for cyclists in the East Village, but after two months they’re still not going over well with some small businesses.

When transportation officials placed bike lanes between the sidewalk and a parking zone, they separated delivery trucks from direct access to many local stores. Some business owners say they’re having more difficulties with deliveries as a result.

The Department of Transportation has begun installing loading zones but even that step may not completely solve the problem.

Liquor License Denied for Diner

Amid protests from angry neighbors, a Community Board panel refused Monday night to recommend that a new liquor license be granted to an East Village diner.

The diner, Table 12, a 24-hour eatery at 188 Avenue A, had applied to the State Liquor Authority committee for a new wine and beer license. The committee regulates liquor licenses in the East Village for Community Board 3.

But those who live near the bar – including about a half dozen residents who held up red signs reading “No More” – asked the committee to reject the request citing concerns about, noise, vandalism and alcohol-related violence.

Good morning, East Village.

Lots of news and good reads from around the neighborhood this weekend and we’d like to start by presenting a tool that we hope can help with the process of sorting through it all. Dave Winer, a visiting scholar at NYU Journalism and a pioneer in all things digital, has developed an aggregator of East Village blogs. It’s another way, thanks to Mr. Winer’s good offices, that we’ve added a little more value to the local blogosphere. Here is his post on how it works and why he built it.

In other neighborhood news, EV Grieve has posts about the shuttering of Bull McCabe’s back garden and compelling images of a pedestrian who was struck by a car on Third Avenue Saturday night.

We’d like to remind you that the State Liquor Authority (SLA) and Department of Consumer Affairs (DCA) Licensing Committee is convening tonight at 6:30 at 200 East Fifth Street (at Bowery). This committee, a part of Community Board 3, which covers the East Village, Lower East Side and parts of Chinatown, makes recommendations regarding appeals for new liquor licenses as well as renewals, alternations, transfers and upgrades.
